I thought this would be better than its own thread because it's a really short question, but I supposedly got a ticket this morning for failing to clear my windshield appropriately.

I say supposedly because the cop said they are going to mail it to me and he looked at my license and registration for about 45 seconds.

If I do get the ticket, has anyone ever had one of these? I'm wondering how much it will be (I'm thinking not much) and whether it's worth fighting.

It was straight-up bullshit, which is the only reason I'd consider fighting it (the principal).

There was an accident on the road right by my house this morning and I, along with 3 other cars, drove through on the opposite side the road (it had just occurred, no one was directing traffic yet, there was a cop and ambulance there, but no emergency lights). After I drive through, the Cop turns on the lights, hammers it to catch up, and pulls me over. he then proceeds to go ape shit on me because I "almost clipped his door off".

He asked me how fast I thought I was going and I said "Maybe 15 mph". His response was "TRY 25!".

The road has a 45 mph speed limit, so whatever I was doing was significantly slower than the suggested speed.

At any rate, he just says "you didn't see us because your windshield has too much snow on it, which was bullshit. it has some frozen droplets of water on the passenger side of the windshield because the defrosters was on while I was cleaning it and the water immediately re-froze when I started driving, but it was perfectly clear.

So that's my story.

Well, I should add that I even stuck to light beer for breakfast (no Canadian lagers, wine or hard liquor) because of the weather.

f-d, I highly doubt you're getting a ticket, because on tickets there's a place you have to sign to promise to appear in court. Without that signature, I don't know how they could ever claimed to have served you with a notice to appear, similar to a subpoena.

I wouldn't worry about it. Just be sure to jot down all these details on a piece of paper for yourself so you do remember them if it ever comes up.

I wouldn't worry about it. Just be sure to jot down all these details on a piece of paper for yourself so you do remember them if it ever comes up.

That's what I thought. I figured he got all wound up for a second and as he started to calm down he realized he just lost it and decided he'd save face with "you'll get the ticket in the mail".

I jotted down every detail when I got into work this morning including time of the stop, temperature, make, model, and color of the other cars, etc.

I never fight tickets, but this one irritated me.

You can absolutely get a ticket in the mail FWIW.

And you should never NOT fight a ticket.

They can send you one after the fact for running red lights and things like that, can't they?

I know they can send you tickets by mail when you get busted on one of those intersection cameras, but that's the only time I've ever heard of that.

The reason that some states now allow the red light tickets to come through the mail is that they changed the offense to a civil one instead of a criminal one, so those tickets don't apply here.

The cases were getting thrown out of court left and right because no one had witnessed the crime. Instead of giving up on the HUGE revenue generator that red light cameras are, they changed the law.

As I stated before, a great reason to join the NMA is that for one ticket a year, if you go to court and fight it and lose, they will reimburse you the fine.

You can get that for speeding, too, in the mail, with cameras set up on stretches of road.

What exactly constitutes a criminal traffic offense. I can't find anything on it

It differs state to state.

The speed cameras are only present in Arizona, and were recently declared unconstitutional due to not being able to face one's accuser.

Not once it's changed to a civil offense. Rules are different for civil vs. criminal charges.

EXACTLY. Had it happen to me. Was involved in a 5 car accident on 76 - I was car #4 and they sent me a ticket for "following to closely."

Fought it and won.

I'm in the left lane, 2 car collision in front of me on right, 3rd car in right lane swerves into left to avoid and I hit him. A fifth car then hit my car and took off(I was out of the car already.)

The cop wrote it up as 3 separate events.

In court:

Officer: Your honor, the defendant struck the car in front of him because he was following to closely.

My lawyer: I object your honor. There are any number of reasons my client's vehicle could have hit the other vehicle. The other vehicle could have been going in reverse. The other vehicle could have been stopped.

Judge: Objection Sustained. Case dismissed.

I had gotten a lawyer because I was worried of a potential lawsuit since they were saying the accident was my fault. When I tried to explain what happened to the lawyer he just kept saying, "it doesn't matter what happened, this is an easy win."

Knowing what I know now I wouldn't have needed a lawyer - I was the only witness because obviously the cop wasn't there at the time of the accident.

I gotcha. Chalk up one of the very, very few cases where the GGB Board of Accident Review MIGHT not revoke a license for someone that was in an accident.

Gee, thanks. Believe me, I was screwed enough. This was back in the early '90s when I was driving a beater - didn't have collision, my car was totaled and the assholes that hit me were eventually caught in Conshy with no license, no registration and no insurance.
