KB - you would think that there is more to it than having the drugs in your house, but there isn't. The Feds can seize the house. I am an attorney and I am also amazed that this is the law. That must have been passed during the Regan years.

I just read the PA state law. If the feds are involved, I imagine it's a different story, but I think we're talking state law here, right?

I would think the owner of the house would have to have knowledge of the drugs for the house to be confiscated.

Everything said by the lawyer types is true. It is a crazy law. I think Andy will be fine though, given his profile and his resources, to prevent that from happening. The courts, most of the time, don't hammer the parents in cases like this. Andy may have to go to madatory Nar-anon meetings (this often happens in NY, I'm not sure in PA)

Could be interesting for a devot mormon to be told you get to pick your own god in this program, but that is for a different thread.

munch, read the PA state law. It's not just drugs in the house, since the would be ridiculous. There are several factors involved.

I owned a rental property in Philly some years back. A friend in the Real Estate business gave me a form (rider) for my leases that stated that if drugs were found on the property, it was cause for immediate eviction. She said it would help me with the Federal & State seizure laws if my tenants got busted.

The law states that if proceeds of drug sales can be linked to purchase, upkeep or financing of a property, it is forfeit as fruits of illegal activity. That includes houses, boats, planes etc.

I don't know who is right.

I'm sure there are certain triggers that must be met (ie- a certain amount of drugs that would push them from possession to trafficing) and there are different laws for federal and local law enforcement.

However, can we all agree Andy Reid is in absolutely no danger of losing his house?

Yeah, this is exactly what I stated earlier. Someone in city hall passed along the wording to me.

fågel's response sounds about right.

They would have to prove the house was being paid for, improved, etc. with drug money to take that house.

Makes sense.

The scary thing is, they don't have to prove that I knew my rent was coming from drug sales, just that the rent money came from drug sales. I could be exonerated and still lose the house. The money was dirty, so the house was dirty. It's a powerful bargaining chip for plea bargains.

Since I doubt Andy's sons were helping him make the mortgage payments or ponying up a few bucks to refurnish the rumpus room, he should be in the clear.
